Judy Moylan's Private Members Bill

AIR SERVICES (AIRCRAFT NOISE) AMENDMENT BILL 2011

Judi Moylan, Federal Member for the W.A. Pearce electorate which covers 14,000 sq kms from Lancelin down to Quinns Rocks in the North West, and Toodyay to Beverley in the East and through the Hills from Mundaring to Carmel has prepared a Private Member's Bill to be put before parliament for the first reading on Monday 4 Jul 2011. This bill is titled "Airservices (Aircraft Noise) Amendment Bill 2011" and seeks to amend both the Airservices Act and the Ennvironmental Protection, Biodiversity and Conservation (EPBC) Act to make ASA more accountable for the impact of aircraft noise on communities.

Mrs Moylan has been very active on the aircraft noise issue over the past few years. When the government failed to adopt the recommendations in the Report of the Senate Inquiry into “The effectiveness of Airservices Australia’s management of aircraft noise” she consulted several community groups, government agencies and the leadership of the coalition to forge this private members Bill in conjunction with the parliamentary draftsman.

Whilst the Report of the Senate Inquiry set out the issues and made sound recommendations in June 2010, the government and it's Transport Minister are unmoved and did not adopt the recommendations, strange really as the government members on the Senate Inquiry did not substantially disagree with the recommendations made.

Mrs Moylan’s Bill adopts the major thrust of the Inquiry recommendations. The amendments sought are precise, unambiguous and will give full effect to the objects of the respective Acts; fixing the deficits identified by the Senate Inquiry. Passage of the Amendment Bill will allow meaningful community consultation and proper environmental assessment of any flight path or air route changes proposed by Airservices Australia. In a great move Mrs Moylan has effectively established "retrospectivity" in regard to WARRP, the plan that is sending all those extra aircraft low over the Perth Hills.
